Terms and Conditions

This is an English translation provided for convenience. The Czech version of these Terms and Conditions is the legally binding one.

Terms and Conditions of Edith K s.r.o., with its registered office at Nádražní 75, 691 81 Březí, Czech Republic, Company ID: 07064853, VAT ID: CZ07064853, registered in the Commercial Register kept by the Regional Court in Brno, file No. C 105955 (the “Seller”), for the sale of goods through the online store at www.osme.cz (the “e-shop”).

1. Introductory provisions

1.1. These terms and conditions (the “Terms”) govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Czech Civil Code, the mutual rights and obligations arising in connection with or on the basis of a purchase contract concluded between the Seller and a natural person (the “Buyer”) through the e-shop.

1.2. The Seller may amend or supplement the wording of the Terms. This does not affect rights and obligations that arose while the previous version of the Terms was in effect.

2. Conclusion of the purchase contract

2.1. The presentation of goods in the e-shop is for information purposes only and the Seller is not obliged to conclude a purchase contract regarding the goods. Section 1732(2) of the Civil Code does not apply.

2.2. The Buyer places an order by adding goods to the cart and completing the order form. Before submitting the order, the Buyer can review and change the entered data.

2.3. The purchase contract is concluded upon delivery of the order confirmation (acceptance) sent by the Seller to the Buyer’s e-mail address.

2.4. The Buyer agrees to the use of means of distance communication when concluding the purchase contract. Costs incurred by the Buyer when using such means (e.g. internet connection) are borne by the Buyer.

3. Price and payment

3.1. Prices of goods include value added tax and all related charges, except delivery costs.

3.2. The price of the goods and delivery costs may be paid by card, Apple Pay / Google Pay, online bank transfer, or cash on delivery (Czech Republic only). The cash on delivery fee is CZK 39 and is included in the price of the COD shipping option selected at checkout. Online payments are due upon completion of the order; with cash on delivery, the purchase price is payable upon receipt of the goods.

3.3. The Seller will issue a tax invoice and send it electronically to the Buyer’s e-mail address.

4. Delivery

4.1. Goods are delivered within the Czech Republic via Zásilkovna/Packeta (CZK 89; with cash on delivery CZK 128) or PPL courier (CZK 119; with cash on delivery CZK 158), and internationally (CZK 400). Current delivery options and exact prices are shown at checkout before completing the order.

4.2. The Seller usually dispatches goods within 2–5 business days of receiving payment (or of order confirmation for cash on delivery), and no later than within 30 days.

4.3. Upon receipt from the carrier, the Buyer must check that the packaging is intact and immediately notify the carrier and the Seller of any defects.

5. Withdrawal from the contract

5.1. A Buyer who is a consumer has the right to withdraw from the purchase contract without giving a reason within 14 days of receiving the goods (Section 1829(1) of the Civil Code).

5.2. Please note: pursuant to Section 1837(g) of the Civil Code, it is not possible to withdraw from a contract for the supply of goods in sealed packaging which are not suitable for return for health or hygiene reasons once the seal has been broken. For perfumes, this means removing the protective foil (cellophane) from the box. The right of withdrawal therefore only applies to goods with the protective packaging intact.

5.3. Withdrawal must be sent within the period under 5.1 to info@osme.cz or in writing to the Seller’s registered office. Please state: order number, date of receipt of the goods, name, address and bank account number for the refund.

5.4. In case of withdrawal, the Buyer shall return the goods to the Seller within 14 days of the withdrawal, undamaged, unopened and in the original packaging. The cost of returning the goods is borne by the Buyer.

5.5. The Seller shall refund all payments received, including delivery costs (up to the amount of the cheapest delivery option offered), within 14 days of the withdrawal, but not before the Buyer has handed over the goods or proved that they have been dispatched. The refund will be made using the same payment method, unless agreed otherwise.

6. Rights arising from defective performance

6.1. The rights and obligations of the parties regarding defective performance are governed by the applicable provisions of the Czech Civil Code (in particular Sections 2099–2117 and 2161 et seq.) and Act No. 634/1992 Coll., on Consumer Protection.

7. Out-of-court dispute resolution

7.1. The Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 796/44, 110 00 Prague 1, ID: 000 20 869, adr.coi.cz, is competent for the out-of-court resolution of consumer disputes arising from purchase contracts.

7.2. The online dispute resolution platform at ec.europa.eu/consumers/odr may also be used to resolve disputes between the Seller and the Buyer.

8. Personal data

8.1. Information on the processing of the Buyer’s personal data is provided in the Privacy Policy.

9. Final provisions

9.1. If the relationship established by the purchase contract contains an international element, the relationship is governed by Czech law. This choice of law does not deprive the consumer of the protection afforded by mandatory provisions of law.

9.2. If any provision of the Terms is or becomes invalid or ineffective, it shall be replaced by a provision whose meaning is as close as possible to the invalid provision.

9.3. These Terms take effect on 23 July 2026, as amended on 8 August 2026.
